Public contract for the provision of services for the organization of participation in the First International Innovative Investment Forum INVESTinUA

This document is an official proposal (offer) of a natural person – entrepreneur Maria Stanislavivna Kucheruk, hereinafter referred to as the “Executor” to any person, institution, organization, hereinafter referred to as the “Customer”, to enter into a contract for the provision of services.
According to the provisions of Art. 633, 641 of the Civil Code of Ukraine, the terms of a public contract are the same for all consumers.
In accordance with Part 2 of Art. 642 of the Civil Code of Ukraine, the Customer’s registration on the Contractor’s website and subsequent payment are the acceptance of the offer (acceptance) of this offer and the conclusion of the contract under the conditions set forth below.

1. Subject of the contract

Under this Agreement, the Contractor undertakes to provide the Customer with services – the organization of the participation of the Customer and/or representative(s) of the Customer in the First International Innovative Investment Forum INVESTinUA, which will be held at the address: Ukraine, Kyiv, 2A Velika Zhytomyrska Street, – hotel “Intercontinental” (hereinafter – the Services), and the Customer undertakes to accept and pay for the Services of the Contractor under the conditions and in the order stipulated by this contract.

2. Obligations of the parties

The executor is obliged to:
Provide services for organizing the participation of the Customer’s representatives and/or the Customer’s representative(s).
Provide Services of appropriate quality and in full.
Provide the Customer with an invoice for the payment of the Services and, at the request of the Customer, a certificate of services provided.
The customer is obliged to:
Pay for the Services at the price specified in clause 4.1. of this contract.

3. Term of provision of Services

3.1. Services are provided directly at the First International Innovative Investment Forum INVESTinUA, which will be held on November 25, 2023.

4. Cost of Services and payment procedure

4.1. The price of the contract is the total amount of services provided.
4.2. Payment for services is agreed upon by the parties in accordance with the volume and cost of services chosen by the Customer.
4.2. The customer makes full advance payment of the cost of services within three days from the moment of receipt of the invoice.
4.3. The Customer pays for the services by transferring funds to the Contractor’s current account specified in this contract, based on the invoice issued by the Contractor.

5. Liability of the parties

5.1. In the event of cancellation of the First International Innovative Investment Forum INVESTinUA, the Contractor shall return the advance payment in full to the Customer.
5.2. If the date of the First INVESTinUA International Innovative Investment Forum is postponed, the Contractor shall inform the Customer no later than 5 days before the INVESTinUA First International Innovative Investment Forum. If the date of the First INVESTinUA International Innovative Investment Forum is postponed, the Customer has the right to refuse the service, in which case the Contractor will return the prepayment amount to the Customer in full.

6. Dispute resolution procedure

6.1. Disputes and disagreements that may arise during the execution of this contract are resolved, if possible, through negotiations between the parties.

7. Final Provisions

7.1. None of the parties is responsible for non-performance or improper performance of the Agreement, if this is caused by force majeure circumstances that the parties could not have known in advance or could not have foreseen. The party that became aware of the occurrence or approach of such circumstances shall immediately notify the other party thereof. Execution of the Agreement is suspended for the duration of such circumstances. If force majeure continues for more than three months, the Agreement is considered terminated.
7.2. The agreement enters into force from the moment of its conclusion by the parties and is valid until its termination by one of the parties, who notified the other 30 (thirty) calendar days before the date of termination of the agreement.
7.3. The parties agreed that the text of the contract, other materials, information and information related to the contract are confidential and cannot be transferred to third parties without the prior written consent of the other party.
7.4. Neither party has the right to transfer its rights and obligations under this Agreement to third parties without the written consent of the other party.
7.5. To conclude a contract in a simple written form, the Customer must contact the Contractor.
